Product information disclosures

This section covers the disclosure of tobacco ingredients and emissions data, of the supply of a new tobacco product, and of sales and marketing data, as well as disclosure requirements for e-cigarettes. Law and policy in this area is UK wide and not a devolved matter. (Article 10 of the WHO FCTC).

Tobacco and Related Products Regulations 2016

Regulation transposing 2014 EU Tobacco Products Directive into UK law on packaging and labelling, product contents and information disclosures, and advertising and sponsorship; only provision on product information disclosures included below. Amended by future legislation including legislation following UK’s EU exit; any amendments included below. See also Impact Assessment and Explanatory Memorandum for more information and background.

Made 18 April 2016, UK wide but Scotland currently considering whether to go further; came into force 20 May 2016 with a sell through period to 21 May 2017.

  • Requires tobacco product producers to disclose ingredients and emissions information including when products are modified; specifies which information is needed.
  • Requires tobacco product producers to disclose sales volume data and market research data.
  • Requires producers to disclose supply of a novel tobacco product; specifies info needed.
  • Requires e-cigarette producers to disclose sales volume data and market research data.
